Terms of Service

These Terms of Service ("Terms") govern your use of the CatchCall website (catchcall.online) and our AI-powered missed-call text-back, lead capture, and appointment booking services (collectively, the "Service"). By using the Service, you agree to these Terms.
1. The Service
CatchCall provides software that detects missed calls to your business, sends automated SMS replies, qualifies leads through short text conversations, alerts on-call staff to emergencies, and books appointments on your calendar. The Service is a communication and scheduling tool; we are not a contractor and do not perform trade work of any kind.
2. Accounts & Eligibility
- You must be at least 18 years old and authorized to act on behalf of your business.
- You are responsible for the accuracy of the information you provide and for activity under your account.
3. Trials, Billing & Cancellation
- New customers may receive a 14-day free trial. No credit card is required for the trial.
- Paid plans are billed monthly, in advance, on the 1st of each month, with a 3-month minimum initial term unless otherwise agreed in writing.
- After the initial term, you may cancel at any time with effect at the end of the current billing period.
- Guarantee: if the Service does not recover at least one real missed-call job in your first paid month, you may request a refund of that month's fee.
4. Acceptable Use
You agree not to use the Service to:
- Send unsolicited bulk messages (spam), or messages that are unlawful, deceptive, harassing, or fraudulent.
- Violate any applicable law, including the Telephone Consumer Protection Act (TCPA) and carrier messaging policies.
- Interfere with or attempt to reverse-engineer the Service.
We may suspend or terminate accounts that violate these rules.
5. SMS Communications
Use of SMS features is additionally governed by our SMS Terms & Conditions, which form part of these Terms. Message and data rates may apply. You may opt out at any time by replying STOP.
6. AI-Generated Content
The Service uses artificial intelligence to conduct text conversations. While we design and monitor conversations carefully, AI responses may occasionally be inaccurate or incomplete. You remain responsible for the services you provide to your customers and for reviewing bookings and alerts.
7. Your Data
Your leads and customer data belong to you. Our handling of personal information is described in our Privacy Policy. We do not sell your data.
8. Disclaimers & Limitation of Liability
The Service is provided "as is" and "as available." We do not warrant uninterrupted or error-free operation. To the maximum extent permitted by law, CatchCall's total liability for any claim arising from the Service is limited to the fees you paid in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost jobs.
9. Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance.
10. Governing Law
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles.
